IMMIGRANT PRO BONO PROGRAM

MTS Law is launching its Immigrant Pro Bono Program that aims to help qualified lawful permanent residents obtain citizenship through naturalization (N400) or apply for the replacement of their green card (I-90). MTS Law will accept one (1) case per month or for a maximum of twelve (12) N400 and/or I-90 cases per year under the program. Clients must meet the eligibility criteria to qualify for the program.

SCOPE OF THE PRO BONO SERVICES

N-400, Application for Naturalization

• Preparing the application package (forms and exhibits)
• Submitting the application to US Citizen and Immigration Services (USCIS)
• Responding to any notices or requests issued by USCIS for which a response is required, including a Request for Evidence or Notice of Intent to Deny
• Preparing the client for the naturalization interview
• Following up or making service requests as needed
• All necessary communication, research, investigation, correspondence, preparation, and drafting of documents required in connection with the matter.

I-90, Application to Replace Permanent Resident Card:

• Preparing the application package (forms and exhibits)
• Submitting the application to US Citizen and Immigration Services (USCIS)
• Responding to any notices or requests issued by USCIS for which a response is required, including a Request for Evidence or Notice of Intent to Deny
• Following up or making service requests as needed
• All necessary communication, research, investigation, correspondence, preparation, and drafting of documents required in connection with the matter.

FEES AND CHARGES

N-400, Application for Naturalization

ualified clients will receive legal services free of charge but will be responsible for all out-ofpocket costs and expenses incurred in the course of representation, including but not limited to USCIS filing fees, outside photocopy/printing services, charges for messenger and courier services, travel expenses, expert witness fees, as may be applicable. We will not charge for in-house photocopying and printing and regular postage.

ELIGIBILITY CRITERIA

To be eligible for our pro bono services, the client must:

  • Not be a previous program client (clients can only avail of the program one time)
  • Must have valid lawful permanent resident status (green card holder)
  • Qualify for a Fee Waiver under any of the following:
    • You or your qualifying family member receive a means-tested benefit (i.e., a public benefit where a person’s eligibility for the benefit, the amount of the benefit, or both is based on the person’s income and resources).
    • Your adjusted gross household income is at or below 150% of the Federal Poverty Guidelines, at the time of filing, based on your household size.

We will make a determination of your eligibility at the time of your application for the program. Our determination of your eligibility for the program will not be affected by a subsequent adverse decision of USCIS in your fee waiver request, if such a request is made. However, please note that a denial of your fee waiver request would result in the rejection of your application.
