Removal proceedings are administrative proceedings to determine the admissibility or deportability of an individual under United States immigration law.  In a removal proceeding, an immigration judge conducts proceedings to decide the inadmissibility or deportability of an alien.

When the proceedings are concluded,  the immigration judge shall decide whether an alien is removable from the United States. The determination of the immigration judge shall be based only on the evidence produced at the hearing.

During the proceedings, the alien has the burden of establishing that he is an applicant for admission and that he is clearly and beyond doubt entitled to be admitted and is not inadmissible under existing laws.  The alien also has the burden of establishing by  clear and convincing evidence that he/she is lawfully present in the United States pursuant to a prior admission.

An individual under removal proceedings may be eligible for some forms of relief from removal, including but not limited to: voluntary departure, cancellation of removal, adjustment of status, asylum, withholding of removal, protection under CAT, certain waivers of removability or inadmissibility, deferred action, and other forms of prosecutorial discretion.
